The age threshold for obtaining parental consent is established by each EU Member State and can be between 13 and 16 years. Check with your National Data Protection Authority.
C. The age at which children must be required to obtain parental consent
GDPR Article Reference:
Article 8(1): This article specifies that the processing of personal data of a child in relation to the offer of information society services is lawful where the child is at least 16 years old. However, member states can provide by law for a lower age, provided that such lower age is not below 13 years. This gives member states the flexibility to determine the age threshold for parental consent within the specified range.
Answer is C - Article 8(1) of GDPR states that Member States may provide by law for a lower age for those purposes provided that such lower age is not below 13 years.
